Version 2026-09-21. These terms apply between Engineer Factory, Lessingstraße 8, 76684 Östringen, Deutschland ("we") and the person or business applying to the Engineer Factory affiliate programme ("affiliate").
1. The programme
1.1 The programme refers customers to the software Engineer Factory through a personal affiliate link and through discount codes we assign to the affiliate.
1.2 Participation requires an application and our approval. We decide freely about approval, rejection, suspension and termination. There is no entitlement to take part.
1.3 The programme is not employment, not a partnership and not a commercial agency. The affiliate acts independently and on their own account.
2. Affiliate link and discount codes
2.1 The affiliate link carries a referral code. Visitors arriving on it are assigned to the affiliate for 30 days by a cookie.
2.2 Discount codes are created, named and set in their percentage by us alone. An affiliate may request a name; the decision is ours. We may change, limit, time-box or disable codes at any time.
2.3 Discount codes may be published only in channels the affiliate runs. Passing them to voucher, coupon or deal sites is prohibited.
3. Attribution of customers
3.1 A customer is attributed to the affiliate when they arrive on the affiliate link and register or buy within the cookie period, or when they use a discount code of the affiliate at checkout.
3.2 Where a link and a discount code of different affiliates coincide, the rule we publish applies (default: the discount code decides). An attribution is made once per customer account.
3.3 The affiliate's own purchases, purchases through the affiliate's accounts or through accounts the affiliate controls, earn no commission.
4. Commission
4.1 The commission is 20 % of the net amount the customer actually paid (after the discount, excluding VAT and payment fees), unless another rate is set for the affiliate or the discount code. We set individual rates in the admin area and show them to the affiliate in the dashboard.
4.2 Commission accrues on the first payment and on renewal payments of a subscription within 12 months of the first payment, and on a Lifetime licence.
4.3 After the purchase a commission is "pending" for 30 days (the withdrawal and chargeback period). It then becomes "available". Commissions are settled weekly.
4.4 Where a payment is refunded, charged back or cancelled, the commission lapses. Commissions already paid are set off against future payouts.
4.5 We may correct commissions that rest on a breach of these terms, a technical fault or abuse.
5. Payout
5.1 Available commissions are paid on request or - when switched on - automatically once they reach € 50. Payment is by PayPal or bank transfer to the details the affiliate provided.
5.2 With every payout we issue a commission statement and, where legally permissible, a credit note (self-billing). The affiliate agrees to the self-billing procedure and informs us without delay when their tax status changes.
5.3 The affiliate is responsible for taxing their income and provides the information needed (country, business status, VAT id, small-business status) correctly and completely.
6. Advertising and disclosure
6.1 The affiliate labels affiliate links and discount codes as advertising as the law applying to them requires (e.g. "ad", "advertisement", "affiliate link").
6.2 Prohibited: misleading statements about Engineer Factory, promises we do not make, advertising on Engineer Factory's brand or product names in search engines, spam, unsolicited messages, advertising in environments with unlawful content, imitating our website, cookie dropping or any other technical manipulation of the attribution.
6.3 Marketing material we provide may be used only to promote Engineer Factory and only unchanged or in the way we approved.
7. Fraud prevention
7.1 We review anomalies (e.g. self-purchases, unusual volume or conversion, repeated refunds, manipulated clicks, duplicate transactions, abuse of discount codes). Anomalies are flagged and reviewed first; nobody is suspended on the basis of an automated procedure alone.
7.2 In case of a breach we may withhold or reverse commissions and suspend the account.
8. Term, suspension, termination
8.1 Either side may end participation at any time with immediate effect. Commissions available at that time are paid out; pending commissions are paid after their period, provided there is no breach.
8.2 On suspension for a breach, commissions not yet paid lapse as far as they rest on the breach.
9. Privacy
9.1 We process the affiliate's data (name, e-mail, country, business, channels, payout and tax details, contract data) to run the programme (Art. 6(1)(b) GDPR) and to meet statutory retention duties (Art. 6(1)(c) GDPR).
9.2 The affiliate receives no personal data about customers, only aggregate figures. The affiliate cookie holds the referral code, not a person. Clicks are counted under a daily rotating pseudonymous key.

10. Changes
We may change these terms. A new version is communicated to the affiliate; it applies to commissions accruing after its publication. If the affiliate objects, participation ends.
11. Final provisions
